The Government of North-West Frontier
Province has promulgated an Ordinance No: XXVII of
2001 on 15 th October 2001 to “streamline, supervise
and regulate the functioning of the private educational
institutions in the North West Frontier Province and
to provide for the registration of such institutions”.
The Ordinance is called the North West Frontier Province
Registration and Functioning of Private Educational
Institutions Ordinance 2001.
An authority called the “Regulatory Authority”
was constituted under the said Ordinance which is
required to examine and scrutinize applications for
the establishment of educational institutions in the
private sector. The Regulatory Authority appoints
a Scrutiny Committee consisting of four members, as
determined by it, and forwards all applications received
by it to the said Committee for Scrutiny in accordance
with the guidelines issued by the Higher Education
Commission and Government and submit its reports to
the Regulatory Authority with its final recommendation.
If the Regulatory Authority favorably recommends the
establishment of the university in the private sector
the Management Committee, the Board of Governors or
the Board of Trustees of the proposed private educational
institution shall furnish a Charter to the Government
in the form of a Bill after obtaining a No Objection
certificate from the Higher Education Commission for
further processing of the bill by Government.
When the bill is passed and enacted as an Act of
the Provincial Assembly (provided that an Ordinance
promulgated by the Governor of the Province in this
behalf shall be deemed to be an Act passed by the
Assembly), the Regulatory Authority shall on payment
of such fee as may be prescribed, issue a registration
certificate and the institution may start functioning
as such.
In the case of colleges, the Regulatory Authority
shall forward all applications received by it to the
Scrutiny Committee appointed by it which shall examine
and carry out inspections to see whether the proposed
institution conforms to the requirement/ criteria
prescribed by the Authority. On receipt of the recommendation
of the scrutiny committee, the Regulatory Authority
shall issue a registration certificate in respect
of the college on payment of a registration fee prescribed
by the Government.
Brief History
The Education Sector has recently shown an unrestrained
growth and lack of discipline. It is therefore necessary
that stringent criteria for both public and Private
Sectors may be prescribed to bring in the much needed
order for improving the quality of Higher Education:
It is realized that Public Sector alone is unable
to cope with the surging demand of Higher Education
from the student community and there is a need to
encourage the private sector. However to put a check
on the unbridled growth of institutions imparting
Higher Education in the Private Sector and to regulate
the functioning of such institutions, the Government
of N.W.F.P has promulgated the Law through an Ordinance
called “ The North West Frontier Province Registration
and Functioning of Private Educational Institutions
Ordinance 2001 Titled NWFP Ordinance No: XXVII of
2001 dated 15/10/2001”.

was issued on 15 th October, 2001.
